AN ORDINANCE AMENDING FEES AND ADDITIONAL SERVICES 

FOR THE WINAMAC MUNICIPAL ELECTRIC UTILITY TO 

THE TOWN OF WINAMAC, INDIANA

Ordinance No. 13 of 2022

WHEREAS, the Town Council of the Town of Winamac, Indiana (the “Town Council”), is responsible for the performance of various functions for the Town of Winamac (the “Town”); and

WHEREAS, the Town Council has determined it is necessary and appropriate to amend certain rates and to provide certain electrical service (“Service”) to the customers (“Customer”) from the Winamac Municipal Electric Utility (“Utility”); and

WHEREAS, the Town Council, having reviewed and considered all recommendations and being duly advised, now concurs that it is advisable, necessary, appropriate, and in the best interest of the residents of the Town of Winamac to re-establish fees and services for the electric utility.

NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Winamac, Indiana, that the following Ordinance Amending Fees and Additional Services for the Winamac Municipal Electric Utility, is adopted as follows:

SECTION I.

Rates and Charges

1. Chapter 52.01(G): The rate for monthly electric usage for security, street lighting and 30-foot pole shall be in accordance with the following schedule:

2. Miscellaneous Charges:

A. For Temporary Charge, there shall be a charge of $100.00 when no more than a single span Service drop and Meter are required.

B. Service Connection Charge:

i. 200 AMP Overhead Meter $ 750.00

ii. 200 AMP Underground Meter $ 750.00

SECTION II.

Additional Services

1. The Utility may, at its discretion, require pre-payment from Customer for the estimated cost of time, materials, supervision, labor, equipment and third-party electric Service design required to modify an existing Service or supply of new Service to the Customer. The pre-payment requirement is especially true for multifamily housing, apartment complex developments and commercial/industrial 3-phase power installations or retrofits. The costs for these Services are often extensive and require pre-purchase of materials by the Utility. As such, each scenario is unique and cannot be covered in a Rate schedule. The Utility, prior to procurement of materials or doing work, shall provide the Customer a cost estimate of the scope of work required. The Customer shall then make full pre-payment based upon the estimate and prior to Utility doing any work. Should the actual cost of the work performed be less than the estimate provided, the Customer shall receive credit for the difference in actual cost to estimate. Likewise, should the scope of work change from that the time of the estimate and require additional costs, the Customer shall be responsible for additional cost and the Utility may require prepayment of said additional cost prior to installation of the work.

2. The Utility may, at its discretion, furnish single-phase Service to an individual Residential Customer at no cost to the Residential Customer. The basic parameters for this no cost Service include: single phase service, overhead 200 amps or less and within 100 feet of existing electrical service. The Utility reserves the right to change from a no-cost Service at any time for any reason within the allowable laws.

3. Any Changes made in Service connections (either overhead or underground) at the Customer’s request, after the original installation, shall be at the Customer’s expense.

4. The Utility may, at is discretion, provide an upgrade at no cost if equipment owned by Utility needs upgraded or if it is in the Utility’s best interest to do so.

5. Meter base, riser, feeder wires, weatherproof connectors and point of attachment are customer owned. A meter base will be provided to the Customer.

6. No meter bases or disconnects are to be installed on Utility owned pole.

SECTION II.

Effective Date

1. Effective Date. That this Ordinance shall take effect, and be in full force and effect, from and after its passage by the Town Council of the Town of Winamac, Indiana.
