RUTHERFORD B. WALTERS, DONNA WALTERS, PHYLLIS PATRICK, and Any Individual or Entity Who Claims or May Claim an Interest in the Real Estate Described in this Action
1. Plaintiff, Equity Trust Company Custodian FBO Erik C. Back IRA, asserts that it has the fee simple interest of one hundred percent (100%) against any and all persons, including Timothy R. Davis, William Sanders, Gloria Sanders, Rutherford B. Walters, Donna Walters, and Phyllis Patrick in and to the following described real estate in Pulaski County, State of Indiana:
Parcel 1:
Part of the Northwest Fractional Quarter (1/4) of the Northwest Fractional Quarter (1/4) of Section One (1), Township Thirty-One (31) North, Range Two (2) West, more particularly bounded and described as follows:
Commencing at the northeast corner of said Northwest Fractional Quarter(1/4) of the Northwest Fractional Quarter (1/4) of Section One (1); thence west 546 feet; thence south to the east line of the Taylor Dredge Ditch; thence southeasterly following the meanderings of said Taylor Dredge Ditch to the east line of said Northwest Fractional Quarter (1/4) of the Northwest Fractional Quarter (1/4); thence north to the place of beginning, containing 6.59 acres, more or less.

Part of the Northwest Quarter of the Northwest Quarter of Section 1, Township 31 North, Range 2 West, more particularly bounded and described as follows:
Commencing at a PK nail with RLH I.D. at the NE corner of the Northwest Quarter of the Northwest Quarter; thence along CR800N, the North Section Line, and the County Line South 89 degrees 57 minutes 34 seconds West 546 feet to a PK nail with RLH I.D.; thence South 00 degrees 2 minutes 26 seconds East 144.85 feet to the East line of the Taylor Dredge Ditch easement and the POINT OF BEGINNING; thence South 00 degrees 2 minutes 26 seconds East 127.15 feet to a Y2 inch ID iron pipe with RLH cap on the East bank of Taylor Dredge Ditch; thence along the meandering of said East bank South 36 degrees 11 minutes 19 seconds East 920.12 feet to a Y2 inch ID iron pipe with RLH cap on the East line of said Northwest Quarter of the Northwest Quarter; thence along said East line North 00 degrees 8 minutes 34 seconds East 126.59 feet to the East line of the Taylor Dredge Ditch easement; thence along said East easement line North 36 degrees 11 minutes 19 seconds West 920.81 feet to the POINT OF BEGINNING; said described tract containing 1.585 Acres, more or less.

Part of the Northwest Quarter of the Northwest Quarter of Section 1, Township 31 North, Range 2 West, more particularly described as follows:
Commencing at a PK nail with RLH I.D. at the NE corner of the Northwest quarter of the Northwest Quarter; thence South 89 degrees 57 minutes 34 seconds West 546.00 feet to a PK nail with RLH I.D.; thence South 00 degrees 2 minutes 26 seconds East 272.00 feet to a Y2 inch ID iron pipe with RLH cap on the East bank of Taylor Dredge Ditch and the POINT OF BEGINNING; thence along the meanderings of the East bank South 36 degrees 11 minutes 19 seconds East 920.12 feet to a ‘12 inch ID iron pipe with RLH cap on the East line of said Northwest Quarter of the Northwest Quarter; thence along said East line South 00 degrees 8 minutes 34 seconds West 19.06 feet to the centerline of Taylor Dredge Ditch; thence along said centerline North 38 degrees 23 minutes 7 seconds West 227.13 feet and North 36 degrees 11 minutes 19 seconds West 681.13 feet; thence North 00 degrees 2 minutes 26 seconds West 33.91 feet to the POINT OF BEGINNING; said described tract containing 0.399 Acres, more or less.
2. The purpose of such proceeding is to quiet the title of said real property as to the party in interest, Equity Trust Company Custodian FBO Erik C. Back IRA, and against the world.
3. Equity Trust Company Custodian FBO Erik C. Back IRA has named as Defendants the individuals and entities within its knowledge through whom any claim, hostile or otherwise, might be asserted.
4. Equity Trust Company Custodian FBO Erik C. Back IRA will move the Court for a judgment in respect to Equity Trust Company Custodian FBO Erik C. Back IRA’s fee simple one hundred percent (100%) interest in the subject real estate at the end of thirty (30) days after the last publication of this notice.
WHEREFORE, Plaintiff, Equity Trust Company Custodian FBO Erik C. Back IRA, prays the Court that it enter an Order determining Plaintiff’s Equity Trust Company Custodian FBO Erik C. Back IRA to be the fee simple owner of one hundred percent (100%) of the interest of the above described real estate in Pulaski County, State of Indiana and to quiet the hostile claims of any and all entities and/or individuals against the same.
