NOTICE OF UNSAFE STRUCTURE AND CORRECTIVE ACTION

DESCRIPTION OF VIOLATION:

You are hereby notified that an authorized agent for the Pulaski County Building Commission has inspected the above-listed Property and determined that the structures located thereon constitute Unsafe Structures, as that term is defined in I.C. 36-7-9. Further, the tract of real property on which the unsafe building is located has also been deemed an Unsafe Premises. The nature of the violations are, as follows:

Code Section Description of Violation 

36-7-9-4(a) The Unsafe Building:

(a) Is in an impaired structural condition that make it unsafe to a person or property;

(b) Is a fire hazard;

(c) Is a hazard to the public health; 

(d) Is a public nuisance;

(e) Is vacant or blighted and not maintained in a manner that would allow human habitation, occupancy or use under the requirements of a statute or an ordinance. 

36-7-9-4(b) The tracts of real property contain Unsafe Buildings, constituting an Unsafe Premises. 

CORRECTIVE ACTION REQUIRED 

Please be advised that you have Sixty (60) days to remedy the above violations, from the date of this Notice.  If you do not comply within Sixty (60) days of the date of this Notice, pending approval by the appointed inspector, the Pulaski County Building Commissioner may begin imposing civil fines, not to exceed Two Thousand Five Hundred Dollars ($2,500.00). The Building Commissioner’s enforcement authority hereby commands you to take the following immediate actions to remedy the above-mentioned violations:

(A) Demolish the Unsafe Structures existing on or about the Premises, which was damaged by fire. For purposes of this Notice, that shall mean all structures located on the Property identified in this Notice;

(B) Remove all trash, debris, fire hazardous material, and other public health and safety hazards on or about the Premises;

(C) Obtain all appropriate demolition permits to accomplish items (A) and (B).
